What is Naturalization?

Naturalization is the process of obtaining U.S. citizenship by a foreign citizen after their initial entry into the country as a permanent resident (an immigrant). There are a number of ways for an individual to become an American citizen, but one of the most common paths involves filing and processing an N-400 application for naturalization.

While green card holders (permanent residents) must wait five years before applying for citizenship, those who do so can enjoy many benefits including increased mobility and travel opportunities. Furthermore, if you hold a green card and wish to become an American citizen, your children born outside the U.S may also automatically be considered citizens under certain circumstances.

Requirements for Naturalization

In order to obtain U.S. citizenship, an immigrant must meet certain eligibility requirements as per USCIS. In general, they must:

  •  Be at least 18 years old (or 15 for those filing under special circumstances).
  •  Have been a permanent resident of the U.S. for five years (or three if married to a citizen).
  • Have a physical residence in the U.S.
  • Be of good moral character.
  • Have basic knowledge of English and U.S. history (and be willing to take an oath pledging allegiance to the U.S.).
  • Be able to write, speak, and understand English.
  • Be able to demonstrate loyalty to the principles of the U.S. Constitution.

How to Apply for Naturalization?

Applying for naturalization begins with the filing and processing of an N-400 form (Application for Naturalization). Applicants can either file the form on their own or seek the assistance of an experienced immigration attorney like Isa Law.

Once submitted, the application will be reviewed by a USCIS officer to ensure that all eligibility requirements are met. Following approval, applicants will be scheduled for fingerprinting and biometric services, as well as a series of interviews and tests which include English and civics exams.

After passing these requirements, a USCIS officer will either approve or suspend the application pending additional investigation.

Suspensions are generally issued for unresolved issues including lack of required background checks and incomplete applications. This is the reason why hiring a qualified immigration lawyer is crucial to ensure the success of your U.S. citizenship application.

How Long Does It Take to Become a U.S. Citizen?

It typically takes an average of six months for the USCIS to process applications for naturalization but may take longer depending on any unresolved issues. In case your application gets suspended, it can take up to 12 months or even more before you are finally approved.
